Terms and Conditions of Service Agreement;
Please read this Agreement carefully before agreeing to join myepe.ca. Please verify that all information provided to myepe.ca is complete and accurate before confirming to this agreement. My Entry to Practice Essentials and myepe.ca will not be responsible for any hardships, interruptions or delays in service, penalties or fee, liabilities or offences as a result of incomplete or inaccurate information provided. Please note that within this document, you the registrant, may be referred to as either the “registrant” or “user” in the terms and policies agreement below.

The registrant, by agreeing the terms and policies herein, knowingly acknowledges, understands, consents to, and soundly agrees to the following; that;

Purpose;
My Entry to Practice Essentials has created myepe.ca as a means of providing general information and improved access to the information, images, products, and scenarios presented on this website. My Entry to Practice Essentials reserves all rights to edit, delete, relocate, modify, or supplement any and all content found within the myepe.ca website at any time, for any reason, without the consent, notification, or other input from any person, organization, or thing thereof.

General Representation;
Representatives of My Entry to Practice Essentials will make efforts to assist with any questions concerning the site, or its content.
With the exception of specially labeled items or products, all information, pricing, labels, and tags are indicated in Canadian funds and terms.

Product Line;
Products presented by My Entry to Practice Essentials and myepe.ca may not necessarily be available or suitable to users/customers outside of Canada and/or may not be indicated for use outside of Canada. In all cases, both inside and outside of Canada, any and all consumer(s), purchaser(s), viewer(s), or users of the information presented by Entry to Practice Essentials or myepe.ca is/are solely responsible and liable for, without exception, any/all matters and situations pertaining to:
  • The content, references, products or images presented by My Entry to Practice Essentials or myepe.ca
  • The utilization, replication, application, transmission, theory discussion or  knowledge transfer of the information
  • The professional conduct, medical treatment and/or skill application of the information

User Commitment;
Any and all consumer(s), purchaser(s), viewer(s), and/or users of the information presented by My Entry to Practice Essentials or myepe.ca is/are solely responsible and liable, whether in public or in private, for any and all situations including, but not limited to, schooling, education, examination, healthcare, business, community, language, culture and professional responsibilities.

The user consents to, and understands, and agrees that access and review of the material presented by My Entry to practice Essentials and myepe.ca does not, in any way, ensure successful completion, in whole or in part, of any known education, university, college, alliance, state, province, or national evaluation, examination or testing. Further, it is understood that My Entry to Practice Essentials and myepe.ca are private entities and have no formal or informal relationships, associations, or business arrangements with any known education format where the information present by My Entry to Practice Essentials or myepe.ca may be applicable.

The information provided at myepe.ca or by My Entry to Practice Essentials staff is not to be considered a suitable substitute for accredited University or likewise curriculums, nor a substitute for medical care from a qualified and registered medical professional. The user understands and assumes responsibility should there be an attempt to substitute the information provided at myepe.ca or by My Entry to Practice Essentials staff for either of the above. If you are not 100% certain regarding the purpose, proper use, benefits, and risks of any information, suggestions, or device presented on myepe.ca, it is recommended that you do not attempt such behaviors and/or consult a qualified and registered medical professional.

The user agrees to indemnify and hold My Entry to Practice Essentials and myepe.ca harmless from any liability, loss, damage, or expense, including assessable legal fees, arising out of the use, reproduction, application or, transference of any information, content, reference, product, or performance found on myepe.ca. Further to this, the user also agrees to indemnify and hold My Entry to Practice Essentials and myepe.ca harmless from any liability, loss, damage, or expense, including assessable legal fees, arising out of any negligent act or omission on their behalf or by anyone for whom they are in law responsible. The user hereto agrees that they shall cooperate with My Entry to Practice

Essentials in the defense of any such action, including providing My Entry to Practice Essentials with prompt notice of any such actions and the provision of all material documentation. The parties further agree that they have a right to retain their own counsel to conduct a full defense of any such action. The user agrees that with respect to the defense of any such action, the user will be available and will provide the necessary assistance to My Entry to Practice Essentials, including the preparation of reports and attendance as witness.

The user shall comply with all applicable Federal, State, Local, School and Health Care laws, ordinances, rules and regulations, including, without limitation, all information, copyright, privacy, medical, health, safety, college and tax laws, ordinances, rules and regulations. The user will indemnify and save My Entry to Practice Essentials and myepe.ca harmless from any and all claims, demands, losses, costs, expenses, liabilities or damages arising out of or relating in any way to the failure by the user to comply with any such laws, ordinances, rules or regulations.

Access to Agreement, Terms and Conditions;
The user understands and acknowledges that they may access this agreement at any time for the purposes of review in the legal section of the myepe.ca site.
User Access to Content;

Trial Membership;
Access to the “Trial” membership found on myepe.ca (represented on myepe.ca as “free trial”), will be granted for a maximum of three-hundred and sixty-five (365) days per year, per user when the user agrees to complete user demographic information and provide accurate and active email contact information.

The user understands that a post-registration confirmation will be send by email to the contact information provided to My Entry to Practice Essential and myepe.ca, and that failure to receive the aforementioned notification is not the responsibility of with My Entry to Practice Essential or myepe.ca.

Any user who does not wish to continue with the “Trial” membership found on myepe.ca (represented on myepe.ca as “free trial”), must voluntarily complete the cancellation protocol outline in the “Termination of Access to Content” procedure outlined in this agreement.  User account information and trial membership withdrawal/termination/deactivation can be found under "My Account" navigation option found in the upper right corner of all MYEPE web pages.

Duration of Paid Membership;
“Paid” membership is defined in this document as any user access to any PCE.com/My Entry to Practice Essentials product where a monetary payment has occurred between the user and either PCE.com or My Entry to Practice Essentials.

Access to any “Paid” membership advertised on myepe.ca, will be permitted access for no more than the advertised number of hours, days, weeks, months or years, as outlined per product on myepe.ca. It should be noted by all user's that the calculation of days following the confirmation notification of successful user registration is as follows; whereby the date of user registration and agreement to the terms and policies herein will count as day one (1) of the terms advertised. Day one (1) of paid access will be calculated as the time between the time of registration and when the time the world clock reads midnight (24:00 hours) eastern standard time.

The user understands that a post-registration confirmation will be send by email to the contact information provided to My Entry to Practice Essential and myepe.ca, and that failure to receive the aforementioned notification is not the responsibility of with My Entry to Practice Essential or myepe.ca.

Any user who does not wish to continue with the “Trial” membership found on myepe.ca (represented on myepe.ca as “free trial”), must voluntarily complete the cancellation protocol outline in the “Termination of Access to Content” procedure outlined in this agreement.  User account information and trial membership withdrawal/termination/deactivation can be found under "My Account" navigation option found in the upper right corner of all MYEPE web pages.

Termination of Access to Content;
Termination/Cancellation of the user account may occur due to;
1. Voluntary Withdrawal from myepe.ca by the User.
2. Mandatory Termination of the users myepe.ca account by My Entry to Practice Essentials due a violation of any or all parts of the agreement herein

Terms and Policies associated to ‘Voluntary Withdrawal from myepe.ca by the User’;
The user understands that they may choose to terminate/cancel their subscription at any time.
2. The user understands that cancellation must be completed by the user by completing the cancellation confirmation procedure that can be found under the "My Account" navigation option found in the upper right corner of all MYEPE web pages.
3. The user understand cancellation will require password confirmation and that once cancellation is complete stored information will no longer be accessible and re-activation of the users account will not be possible or permitted.
4. The user further understands and agrees that the user will not receive any refund of the annual fee, in full or in part, prorated or otherwise, if cancellation is initiated following the completion of the registration process, unless otherwise appealed and agreed to by My Entry to Practice Essentials as per the terms and policies set forth in this agreement.

The user understands that a post-cancellation confirmation will be send by email to the most up-to-date address on file with My Entry to Practice Essential and myepe.ca, and that failure to receive the aforementioned notification is not the responsibility of with My Entry to Practice Essential or myepe.ca.

The user understands that once cancellation is confirmed, the account and all records associated to the account will be inaccessible to the user and re-activation of the users profile will not be possible or permitted.

Further, the user consents and agrees to allow My Entry to Practice Essentials and myepe.ca to maintain and hold contact information, user profile information and other stored information including, but not limited to, notes, studies, blogs, videos, or images for the purposes demographic collection, research, product development and quality assurance.

Following account cancellation the user agrees to allow My Entry to Practice Essentials and myepe.ca to contact the user by email regarding other My Entry to Practice Essential programs, offers and opportunities.
The user understands that cancellation of contact via email may be completed by responding by email “no more thank you”.

Terms and Policies associated to ‘Mandatory Termination of the users myepe.ca account by My Entry to Practice Essentials due a violation of any or all parts of the agreement herein’;
The user understand that cancellation as a result of contractual breach will be immediate upon the discovery of the breach.
The user understands that cancellation due to the aforementioned circumstances will NOT require password confirmation by the user.
The user understands that once cancellation has been completed due to the aforementioned circumstances, the stored information will no longer be accessible and re-activation of the users account will not be possible or permitted.
The user further understands and agrees that the user will not receive, or attempt to pursue, any refund of the annual fee, in full or in part, prorated or otherwise, if cancellation is due to the aforementioned circumstances.
The user understands that no appeals process for the return of funds will be considered in cancellations arising from a contractual breach.
The user understands that a post-cancellation confirmation will be send by email to the most up-to-date address on file with My Entry to Practice Essential and myepe.ca, and that failure to receive the aforementioned notification is not the responsibility of with My Entry to Practice Essential or myepe.ca.
The user understands that once cancellation is confirmed, the account and all records associated to the account will be inaccessible to the user and re-activation of the users profile will not be possible or permitted.
Further, the user consents and agrees to allow My Entry to Practice Essentials and myepe.ca to maintain and hold contact information, user profile information and other stored information including, but not limited to, notes, studies, blogs, videos, or images for the purposes demographic collection, research, product development and quality assurance.
Following account cancellation the user agrees to allow My Entry to Practice Essentials and myepe.ca to contact the user by email regarding other My Entry to Practice Essential programs, offers and opportunities.
The user understands that cancellation of contact via email may be completed by responding by email “no more thank you”.
Suspension of Access to Content;
My Entry to Practice Essentials and myepe.ca reserve the right to suspend access to the content found on myepe.ca for a maximum of thirty-days (30) in the event that a suspicion of a breach to the any or all of the agreement set forth herein.
The purpose of the suspension is to allow My Entry to Practice Essentials and myepe.ca to conduct a comprehensive evaluation and determination as the validity and extend of any allegations pertaining to the breach of the agreement set forth herein.
In the event that a breach has occurred, Termination of Access to Content will ensue.
In the event that no breach is found, reinstatement of access to the content found on myepe.ca will commence without further delay, but without penalty, refund, or other hardship to My Entry to Practice Essentials and myepe.ca
Fees and Payments;
Fees; will be in the amount(s) and currency, set forth on myepe.ca at the user registration area or in the “sign up”, “free trial”, and user information registration pages. If otherwise not indicated, it can be assumed that all posted fees are in Canadian funds. In all instances and without exception, fees will have applicable taxes, levies, and interests added as set forth by the laws of the users country, state, province or region as they coincide with the time and date this agreement is signed. Payment; one time change for outlined set fee, plus applicable taxes, levies and interests will automatically be charge to the payment service select by the user at the time of user registration and signing of this agreement. The user additionally agrees to the terms, policies, and laws of the Stripe Payment Gateway (https://stripe.com/ca/terms).
Payment Failure: In situations where billing is suitable and has been agreed upon, in the event that the user’s payment is declined, the user agrees to the following;
The user account and access to the myepe.ca content will be restricted at the discretion of the My Entry to Practice Essentials.
The user will be recurrently notified by email of the payment decline for the term of thirty (30) days, followed by which time the account will be ruled as abandoned and the user account, billing information and all other information will be treated as per the terms and policies set forth under the termination/cancellation terms and policies in this agreement.
Recurring/Frequencyof Payments; In situations where billing is suitable and has been agreed upon, the user understands and agrees to automatic recurring payment on the anniversary date (example: weekly, monthly, yearly) from the agreed upon terms at the time and date of registration, or upon the first business day thereafter in the event that the payment gateway in closed on the date of renewal. The user agrees to payments:
In the amount outlined at the time of user registration and account set up plus applicable tax, levies and interests for the ongoing, uninterrupted access renewal of the users membership and account information to myepe.ca
The user understands and acknowledges that they will receive a post-payment confirmation email following all automatic recurring payments.
The user further understands and agrees that the user will not receive any advance notice of this payment, other than the one provided following registration, but will receive post-payment confirmation by email to the address provided during registration.
The user understands and agrees that it is universally the users responsibility to ensure up-to-date status and accuracy of the users email and billing information.
The user understands and agrees that My Entry to Practice Essentials, myepe.ca, and Stripe Payment Gateway will not be liable or held accountable for any fees, charges, liability, loss, damage, or expense, including assessable legal fees or failures to receive recurrent billing/post-payment confirmation as a result of failure by the user to comply the maintenance the required contact and billing information.
Automatic Recurring Payment Failure; In situations where recurrent billing is suitable and has been agreed upon, in the event that the user’s automatic recurring payment is declined, the user agrees to the following;
The user account and access to the myepe.ca content will be restricted at the discretion of the My Entry to Practice Essentials.
The user will be recurrently notified by email of the payment decline for the term of thirty (30) days, followed by which time the account will be ruled as abandoned and the user account, billing information and all other information will be treated as per the terms and policies set forth under the termination/cancellation terms and policies in this agreement.
Refunds / Free of charge Access;
My Entry to Practice Essentials reserves the right to refuse the return of funds following the engagement of terms outlined through the "Fees and Payments" and in consideration of the “Pass or it's free”  promotional offer detailed below.
My Entry to Practice Essentials also reserves the right to consider applications for refund from time to time, but reserves the right to refuse such applications without further question. Consideration for refund will be based on criteria three (3) through five (5):
My Entry to Practice Essentials reserves the right to consider applications for a 90% refund when such applications are submitted within the first seven (7) days following conversion to a paid membership provided the application consists of proof of extenuating circumstances which My Entry to Practice Essentials feels are unique and valid.
My Entry to Practice Essentials reserves the right to consider applications for a 50% refund when such applications are submitted between day seven (7) and day thirty (30) following conversion to a paid membership provided the application consists of proof of extenuating circumstances which My Entry to Practice Essentials feels are unique and valid.
No eligibility for refund will be considered for any paid memberships that have been active for 30 days or more.
“Pass or it's free” Promotion (July 1, 2019 - Current);
The “Pass or it's free” offered by Entry to Practice Essentials and myepe.ca is an agreement between Entry to Practice Essentials/myepe.ca and the registered account holder.
In this agreement the registered account holder (user) understands and agrees to:
Challenge Canada’s Physiotherapy Competency Exam (PCE) at each and every viable opportunity, for as long as is permitted by the body in charge of administering the PCE.
Make every effort to pass the PCE for the purposes of becoming a licensed Physical Therapist in Canada
Upon learning of an unsuccessful attempt at the PCE, inform Entry to Practice Essentials and myepe.ca by email at info@myepe.ca or support@myepe.ca.
Upon learning of an unsuccessful attempt at the PCE, submit written proof of the unsuccessful attempt to Entry to Practice Essentials and myepe.ca by email.
Upon learning of an unsuccessful attempt at the PCE, accept continued access to the content provided by Entry to Practice Essentials and myepe.ca free-of-charge until the date of the soonest possible opportunity to challenge the PCE.
Continue to accept access to the content provided by Entry to Practice Essentials and myepe.ca free-of-charge until all possible attempts at the PCE are completed.
In this agreement, and following the receipt of written evidence supporting the claim for each unsuccessful attempt at the Physiotherapy

Competency Exam (PCE) by the user, Entry to Practice Essentials and myepe.ca understands and agrees to;
Maintain the users access to the users membership account free-of-charge until the users next scheduled re-attempt at the failed portion of the PCE.

Assist the user wherever possible to facilitate a successful outcome on the Physiotherapy Competency Exam (PCE)
Provide review of the users MyEPE usage and MyEPE exams in combination with PCE feedback to formulate a study plan, identification of areas where exam strategies and tactics can be improved, and to help with questions the user may have regarding topics or testable material.
Provide 1:1 mentorship and guidance as needed. .
Maintain confidentiality regarding the unsuccessful PCE attempts made by the user

The user is required to read, understand, and accept the terms of the “Payment Gateway” which follows
Terms and Conditions of Service Agreement: Electronic Authorization;
This Agreement is not transferable and must be agreed to by the person authorized on the myepe.ca account, by checking "I Agree To This Terms Of Service Agreement" at the time of registration of a My Entry to Practice Essentials user account.
Payment Gateway

AGREEING TO THESE CONDITIONS
By providing my credit, or paypal account, or bank account information ("Payment Method"), I AGREE that I have read and understand the following agreements, terms and policies; Terms and Conditions of Service Agreement; Purpose; General Representation; Product Line; User Commitment; Access to Agreement, Terms and Conditions; User Access to Content; Termination of Access to Content; Suspension of Access to Content; Fees and Payments; Refunds; Money Back Guarantee; Policies; Terms of Service Agreement: Electronic Authorization;Website Usage Policy;Confidentiality Policy;Privacy Policy;Payment Gateway.  
In addition, I authorize My Entry to Practice Essentials to charge the full amount required (one year membership) to the specified Payment Method; and I authorize the financial institution for the Payment Method, specified above to charge or debit my account and remit payment for my enrolment to My Entry to Practice Essentials. This authority will remain in effect until I give notification, as required under this Agreement, to terminate this authorization.

I HAVE READ AND AGREE TO THE ABOVE STATEMENTS, I AUTHORIZE MY ENTRY TO PRACTICE ESSENTIALS TO CHARGE/DEBIT MY SPECIFIED ACCOUNT AS PER THE CONDITIONS ABOVE.

My Entry to Practice Essentials shall not be liable for any damages, personal loss, personal injury resulting from, or believed to be resulting from, direct or indirect access to, or inability to access, this site, or from your reliance on any information provided on this site.

The content of this site whether owned or controlled by My Entry to Practice Essentials, or one of its associates, is protected under any and all applicable copyright and trademark laws of Ontario and Canada. Downloading content, whether for personal use, commercial or non-commercial use is not endorsed or permitted by My Entry to Practice Essentials and My Entry to Practice Essentials will not be held accountable for any outcomes, consequences, or results from violations herein. By accessing this site the user My Entry to Practice Essentials and the website myepe.ca cannot be held responsible or liable for any damage, loss, or injury arising out of:

Confidentiality Agreement

My Entry to Practice Essentials does not accept, encourage, promote or condone the sharing or distribution of confidential examination or educational materials. The user agrees not to disclose, in person, in writing, online, or otherwise, any confidential information pertaining to any person, community, board, education system or testing, except as permitted by law.
In the event the user becomes aware that they, or another user, or another individual in association with My Entry to Practice Essentials or myepe.ca is in violation of maintaining the confidentiality of sensitive material as discussed herein, or applicable to other privacy legislation, the user shall notify My Entry to Practice Essentials of the violation as soon as reasonably possible, but not later than twenty four (24) hours after the user becomes aware of such violation.

The user/supplier of who violates or supplies information about individuals who violate this agreement further agrees to indemnify and hold harmless My Entry to Practice Essentials from any and all liabilities, damages, fines, penalties, costs, claims, demands and expenses (including legal costs associated with defense, settlement and reasonable attorney’s fees), arising out of the disclosure or improper use of confidential examination or educational materials or information by the user or the user’s agents or associates.

The user recognizes that the disclosure confidential examination or educational materials may give rise to irreparable harm and acknowledges that remedies other than injunctive relief may not be adequate. Accordingly, My Entry to Practice Essentials has the right to seek equitable and injunctive relief to prevent the unauthorized disclosure of any confidential examination or educational materials, as well as such damages or other relief as is occasioned by such unauthorized use or disclosure.
In the event the user is required to disclose confidential examination or educational materials in connection with any judicial proceeding or government investigation, then the user shall notify My Entry to Practice Essentials as soon as reasonably practicable, but not later than twenty four (24) hours after the user becomes aware of such proceeding or investigation.
Privacy Policy

The following policy outlines the types of information that we gather about you and the way we use and don't use this information. The information that we collect about our visitors falls into three general categories:
Information You Provide to Us. We may collect and store information, personal or otherwise, that you voluntarily supply to us either on the myepe.ca site, via e-mail, or in any other way. Some examples of this type of information include the information you submit (such as your name or e-mail address) when you submit questions to our site. If you decline to supply or provide us with certain information, we may not be able to provide you with some services that are dependent on the collection of this information.

In addition, we may also provide third parties with information about our visitors for a variety of reasons and purposes. Therefore, we reserve the right to use and to disclose to third parties all of the information that we collect about you and our other visitors in any way and for any purpose, with one important exception. The privacy policies of these co-branded sites and third parties are not necessarily under our control. The use of any information that you may provide to any co-branded site or to any third party may be governed by the privacy policy of the operator of the site that you are visiting, which may differ from ours.
